Terms of Service

1. Who we are

Halfway Express is a South African software service operated from the Western Cape by Halfway Express (the "Service", "we", "us"). The Service is reachable at admin@halfwayexpress.co.za. By using the Service you agree to these Terms.

2. What the Service does

Halfway Express provides QR-code halfway-house ordering for golf courses. We offer two paid sides of the marketplace:

  • Courses subscribe to operate ordering on their property. They get a branded player view, kitchen tablet view, menu admin, and reports.
  • Sponsors subscribe to appear on the order confirmation pages of one or more courses. Sponsorships rotate across all approved sponsors at each course on a least-recently-shown basis.

Players use the Service anonymously by scanning a course's QR code. Players do not create accounts. Players pay for food and drinks directly at the course counter — Halfway Express does not process player payments.

3. Accounts and approval

Anyone can sign up at /onboard (course) or /sponsor/signup. Activation is gated by (a) successful payment of the relevant setup and first-month fees and (b) approval by Halfway Express's super administrator. We reserve the right to refuse or revoke any account where we believe doing so protects the integrity of the Service or its users.

You are responsible for keeping your sign-in email secure and for all activity under your account. Sign-in is via magic link only — there are no passwords. If a magic link is sent to a wrong address by your action, the resulting account access is your responsibility.

4. Pricing and billing

Pricing is published at /pricing and is denominated in South African rand (ZAR). Charges include the once-off setup fee for courses (R1,799 or R3,599 depending on tier), the monthly course subscription (R1,500/month), and sponsor subscriptions (R999/course/month with volume discounts as published). All fees are inclusive of VAT where applicable.

Recurring subscriptions are billed monthly via PayFast using a tokenised card on file. By subscribing you authorise Halfway Express to charge that card on the recurring schedule until you cancel. After three consecutive failed recurring charges your account will be automatically suspended pending resolution.

14-day trial. After activation, courses have 14 days during which the first month's subscription fee may be refunded in full upon written cancellation to admin@halfwayexpress.co.za. Once-off setup fees and subsequent months are non-refundable.

EFT. Where electronic funds transfer is used as a payment fallback, the invoice is considered paid only when funds reflect in our account and we manually mark the invoice as paid. Recurring subscription is unavailable on EFT.

5. Acceptable use

You agree not to use the Service to:

  • Place fraudulent, abusive, or test orders intended to disrupt a kitchen.
  • Submit lead-capture form data using emails you do not control.
  • Upload menu, brand, or sponsor content that is offensive, misleading, or infringes intellectual property.
  • Reverse engineer, scrape, or attempt to access another tenant's data.
  • Resell, sublicense, or repackage the Service without our written consent.

6. Sponsor content and rotation

Sponsors warrant that all logos, brand names, taglines, and websites they upload do not infringe third-party rights. Halfway Express may remove sponsor content that we reasonably believe breaches these Terms or applicable law. Course administrators may, at their sole discretion, block individual sponsors from rotating on their own course; the sponsor remains entitled to rotation at their other approved courses.

Lead-capture form submissions are shared with the sponsor whose block was active on that confirmation page, and only with that sponsor. Halfway Express does not share leads across sponsors or sell them to third parties.

7. Data and privacy

Your use of the Service is also governed by our Privacy Policy, which forms part of these Terms. We comply with the Protection of Personal Information Act (POPIA) where applicable.

8. WhatsApp delivery

Orders are delivered to the kitchen via the WhatsApp deep-link mechanism (a player's phone opens WhatsApp with a pre-filled message addressed to the kitchen tablet's number). WhatsApp is operated by Meta Platforms and is governed by their own terms. Halfway Express is not responsible for WhatsApp downtime or delivery delays.

9. Service availability

We aim for high availability but do not guarantee uninterrupted service. The Service may be unavailable during scheduled maintenance, third-party outages (Supabase, Vercel, Resend, PayFast, WhatsApp), or other circumstances beyond our reasonable control.

10. Limitation of liability

To the maximum extent permitted by South African law, Halfway Express's total aggregate liability arising from your use of the Service is limited to the amounts you have paid us in the twelve (12) months immediately preceding the claim. We are not liable for indirect, consequential, or special damages, including loss of profits, loss of customers, or reputational harm.

11. Termination

You may cancel your subscription at any time by writing to admin@halfwayexpress.co.za. Cancellation takes effect at the end of the current billing month — you remain liable for the in-progress month. We may suspend or terminate your account immediately if you breach these Terms or fail to pay.

12. Changes to these Terms

We may update these Terms from time to time. Material changes will be communicated to account holders by email at least 14 days before they take effect. Continued use of the Service after changes take effect constitutes acceptance.

13. Governing law

These Terms are governed by the laws of the Republic of South Africa. Any dispute will be referred to the courts of the Western Cape, unless we agree in writing to alternative dispute resolution.
